Beccaria, Lichtenberg, and the Failure of Left Dhimmi Jurisprudence

I'm fully in favor of capital punishment, and I hope I would remain so even were I sentenced to death under the legitimate rule of law in a legitimate state; however, whether I were to be subject or not to torture before hand, I can't think of any good reason to support it, and I have one good reason to forego it: regardless of the advantages of gleaning information from one under torture, the benefit is lost in our becoming torturers. Beccaria argues against capital punishment on that same ground, and I do suggest he is wrong in it.

Torture demeans us, and capital punishment ennobles us. To torture a person is to accept their Humanness and to deliberately degrade it and nullify it for the sake of others. To torture is to shame, other aspects of it being negotiable. To shame is to destroy another's Humanness, which destroys ones own, a far too high a price to pay. One cannot bravely face torture. The point of torture is to deface the person so he has no bravery, no courage, not Humanness left in him, at which point he is tortured fully. Anything to be gained through that is not worth the having. But death is a different occasion. I accept it as occasion for the possibility of an act of courage. Nevertheless, for the executioner, capital punishment is not an act of personal volition and responsibility, per se. Killing people isn't Good; but sometimes killing people is Right. On those occasions of capital punishment, one might consider it an act of ennoblement of all concerned.

When a legitimate authority sentences a criminal to his punishment, then death is a good thing and right. Death shows to the community and to the one punished that Life is our highest value: To kill a criminal is to show that we take the crime so seriously that we will make the payment so severe that it transcends all other of our values in this case. We prize life so highly that we will take it from those who do not deserve it. We will go even that far. We won't defile ourselves by humiliating another for the sake of our own gain; but we will show to all that we value life so highly that we take it and destroy it rather than allow one to have it who has transgressed against us.

Our culture is askew. We seem not to know the difference between insult and outrage, the difference between traduce and trespass. Often we live in fear. Or we have no fear whatsoever.

I do not know of any exception to this general axiom, that every member of society should know when he is criminal and when innocent. If censors, and, in general, arbitrary magistrates, be necessary in any government, it proceeds from some fault in the constitution. The uncertainty of crimes hath sacrificed more victims to secret tyranny than have ever suffered by public and solemn cruelty.

We must be deprived of the use of our senses: for one motive that induces a man to commit a real crime there are a thousand which excite him to those indifferent actions which are called crimes by bad laws....

Would you prevent crimes? Let the laws be clear and simple, let the entire force of the nation be united in their defence, let them be intended rather to favour every individual than any particular classes of men, let the laws be feared, and the laws only. The fear of the laws is salutary, but the fear of men is a fruitful and fatal source of crimes.

Stern punishments for trivialities; trivial punishments for inhumanities callously committed. We now know less and less about things more and more important daily. Where the foulest of crimes go unpunished, the slightest of imagined insults brings down upon the man the wrath of the Gnostic estate.

A contemporary of Beccaria understood the problems of our jurisprudence as if he were looking through a time machine:

Nerds Go Crazy!

I know that most of you think it's great being a nerd, and that you'd like to be a nerd too if only you had the chance. You all might think it's cool to hang out in the library fussing over the minutia of 1,400 year old documents written in a dead language. Yeah. Like that's where all the babes hang out, right? Lemme 'splain it to you: Being a nerd isn't any fun at all. Oh, sure, it looks like fun, but when you're right in there down and dirty defending your thesis, then you find out just how vicious people can be and evil life is. And when some bully on the street pushes you away from the seat you wanted at the patio bistro, what do you do? You go sit somewhere else and stew over it while you read yet more epistles from Bishop Epiphanius. It looks cool, but what you really want to do is go tell that bully he's not nice and that you're smart and you have a really great job and that you're special and stuff. But, being a nerd, none of that is possible. Until that one day when everything changes....

There you are leafing absent-mindedly through the faculty bulletins and you suddenly see a "Junket to a Third World fly-speck shit-hole to be seen with a psycho dictator" application. Is that cool? You might still be a nerd but the photos of you will look extra special and hardly anyone will ever know you're really better at research than being a Cold-Eyed Killer of the Globo-Nazis. Ward Churchill: is perhaps one of the most provocative thinkers around. A Creek and enrolled Keetoowah Band Cherokee, Churchill is a longtime Native rights activist. He has been heavily involved in the American Indian Movement and the Leonard Peltier Defense Committee. He is Professor of Ethnic Studies at the University of Colorado and has served as a delegate to the UN Working Group on Indigenous Populations.

One of Churchill's areas of expertise is the history of the U.S. government's genocide of Native Americans—the chronic violation of treaties and systematic extermination of North American indigenous populations. He said that the U.S.-led Coalition forces and the Iraqi Army use the military strategy of cutting off food and water supplies to cities under attack by insurgents, which frequently use the civilian population as human shields. In 2006, Ziegler criticized Israel's war with Hezbollah, stating that the International Criminal Court should investigate whether Israel is guilty of war crimes for a bombing campaign in Lebanon that blocked access to food and water. Specifically, Ziegler stated that "The government of Israel should be held responsible under international law for the violations of the right to food of the Lebanese civilian population.".... Ziegler has also reportedly stated on Television that "The Israeli occupation is a colonial regime and an illegal military occupation from the UN's point of view, it continues to annex more Palestinian lands; and thus the Israeli occupation is the worst in the history of colonialism."

According to The Forward: "In July [2005], [Ziegler] told a crowd of pro-Palestinian demonstrators in Geneva that Gaza was "an immense concentration camp" and added that it was a good thing that the "guards" were about to leave. This elicited a rare rebuke from a spokesman for Annan and from human rights commissioner Louise Arbour." Ziegler later protested the interpretation that he was comparing Israelis to Nazis.

In 1989 - four months after Libya bombed Pan Am flight 103, killing 270 people from 21 countries - Ziegler launched the annual Muammar Qaddafi Human Rights Prize in Tripoli, boasting it was the "Anti-Nobel prize of the third world". In 2002, he praised the Zimbabwean dictator, saying, "Mugabe has history and morality with him."

In 2006, Ziegler said, "I refuse to describe Hezbollah as a terrorist organisation. It is a national resistance movement. I can understand Hezbollah when they kidnap soldiers ..."

Ziegler calls the US an "imperialist dictatorship" guilty of genocide, and labels George W Bush "the Pinochet who sits in the White House"; 9/11, he alleges, was used by Bush as a "justification for the staging of organised economic destruction of the people of the southern hemisphere".

He claims western capitalism has "put the planet under the scalpel of organised economic destruction", its leaders deliberately organising starvation as a "weapon of mass destruction". Western capitalism "kills, destroys, slaughters ... for no other reason than the desire for maximum profit for some cosmocrats who are driven by an obsession for power and unlimited greed"....

It's a mystery to me why I don't have a job as a U.N. advisor to starving people. My first bit of fine advice would be to eat Jean Ziegler. That kind of brilliance qualifies me to have a great U.N. job. Eat Left dhimmi fascists. I urge the liberal use of ketchup. Pour it all over Ziegler and dig in. It really doesn't matter how one serves him up so long as the ketchup is first class, not some generic cheap stuff. If our world is being taken over by primitives, then let's get into it and set up for what Tatian rightly calls "The cannibal banquet of the soul." Let's sart with Ziegler and work our way down, as it were.

Are these guys homosexuals who want o make it into a porn mag. and don't have the physique so they try for the macho look by posing with guns? Or are they weaklings who want to pretend they're tough guys? I'm sure enough that the average doe would slap down these idiots, so it's not like they go hunting. It's all a pose to make themselves fit in as cool guys, as one of the gang. These middle-class fools want to play at being Robin Hood or some fucking thing. Phantasy. But they get real people killed playing this game. They are Death Hippies. I really urge hungry people to eat them.

It's fun being a Gnostic

This handsome devil pictured below was released from jail for drunkenness and threatening people at his daughter's school a few days ago. The police picked him up; the judge let him go. "Mr. Schoenborn was arrested and charged with two counts of uttering threats, but was released from custody later that day, over the objections of police."

The National Post continues: "... What was in front of the Judicial Justice of the Peace was a "blow-up at a school," said Hugh Stansfield, [B.C.'s Chief Judge of the Provincial Court.] "And a fellow that had a couple of convictions for drinking and driving, and driving while suspended, and not much else." He said the JJP could not have imagined that, "this gentleman was going to do the unspeakable."

Shoenborn went to his estranged wife's trailerhouse and, while she'd ducked out to do some shopping, he killed his three children, "Kaitlynne, 10, Max, 8, and five-year-old Cordon Schoenborn."

Shoenborn is still, as of this writing, on the loose.

"Mr. Schoenborn was not identified as the murder suspect for 18 hours, well after police were called to the crime scene."

One must wonder.

"In Merritt, police are warning the public not to approach Mr. Schoenborn, should he appear on a doorstep or in a back yard. In what might well be an major understatement, Const. Linteau says he "could be dangerous"."

Done is done, and no accusations will undo it. Our only question: What is to be done next? What about the capture and punishment of this man? He's sure to go to jail this time, and likely forever, but is it enough? Ah.... Already there is much heated discussion of Shoenborn being mentally ill, his actions 'not being his fault,' the insinuation being. And from there it's a short hop to wondering whose fault it is. Yes, the man will go to jail forever and a day. Unless he doesn't. It could be that society drove him mad, that his childhood was too difficult for him to adjust later to the world of others; and that because we, i.e. the government, didn't do enough to save him, he committed some heinous crimes which the medical establishment can keep him from repeating. A couple of years, a few kilograms of med.s, and out he goes onto the streets. If only we as a society had done more prior to this crime, if we can call it that, the children would still be alive. Shame on us.

Frankly, I get real tired of that kind of pseudo-reasoning. Let's capture the man, try him, hang him, and then go after the ones who have concocted such a society where the average citizen is bullied and terrorized into believing he/she is a criminal for not giving enough unto the Church of Social Engineering, a society where the Gnostic elites decide the lives and deaths of the masses from on high; and the people pay for it, and pay with their lives at times. It's the same lot spread wide across the world, those who know better, see more clearly, understand more deeply the darkness of the Mystik. Gnostic experts. If only they had more money to do more good, just a bit more power to do a bit more Good.

They do a thankless job well and they are necessary. I don't blame the judges for the most part, they being constrained by the system and the times, they not being intellectuals of any real sort, not philosophers, not creative thinkers, not being much more than highly trained law clerks. We do have the genuine intelligentsia to look at for the problems we face. We have even the average person on the street who parrots stupid social engineering cliches and who perpetuates this evil by giving permission to others to repeat it till it is the public norm. When many say it, few object when others do it. A simple solution? Make it clear to them, even some poor schmuck on the sidewalk, that it's intolerable to listen to such vile social engineering and social gospel rubbish. For a reasonable world in a reasonable time, we must take the fun out of being a Gnostic. Let's be obnoxious (to a degree) with those who simply chirp along with the cliches of the day. Of the worst? Let's make some many swinging bird-feeders. Life still won't be perfect but it'll sure be a lot safer for most and less infuriating for some.

The Airs of Modernity

Modernity. From a horny speeding Muslim bigamist to a gang of rampaging kids who just don't care to nihilistic kids who just don't care to suicidal kids who just don't care to childish adults who could care less to rampaging kids who just laugh it off, as below, our societies are in trouble when it comes to self-control. If adults can't control themselves, why would they think of controlling children? Is this Modernity?

It might be the mass communications of Modernity that allow us a look at details from a greater number of places and peoples, but the seeming reality is that Modernity is birth control, abortion, egoism and hedonism, that have shrunk our Modernist populations to something close to catastrophic levels. Too many of the children we do have are violent, feral creatures we must fear or hate. Those we might rather keep we have to buy bulletproof knapsacks for. I could be in the minority but I do think something ain't quite right with our Modernity. Perhaps it's a matter of emphasis:

SYDNEY (AFP) - Five teenage boys armed with machetes and baseball bats invaded a Sydney high school Monday, smashing classrooms and injuring 18 students and a teacher, police said.

Merrylands High School in Sydney's west went into "lockdown" with pupils barricaded in their classrooms as the intruders assaulted students and shattered windows before police arrived and arrested them.

One girl was admitted to hospital with cuts to her face from flying glass and a teacher was taken to hospital with bruising to the back of his head after trying to restrain one of the attackers, an ambulance service spokesman said.

"We've assessed 18 school-aged children ... all having minor injuries, some lacerations, some bruising and they're obviously quite anxious about what has happened," the spokesman said.

Some students hid under tables and in cupboards while their teachers barricaded the doors as the youths rampaged through the school.

"They were carrying baseball bats and two had machetes. I thought I was going to die," said Grade 12 student Emma McQuillan.

"Teachers just told us to get down. Students were just crying and screaming," she told the Daily Telegraph.

Another writer, calling himself I luv Carly, says: "F... da cops" and lists his crimes as assault, grievous bodily harm, attempted murder, break and enter, possession of an illegal weapon, and armed robbery. "Might be doing 6 to 18 months," he said.

They form largely along ethnic backgrounds and congregate on neighbourhood streets as they flirt with the law - carrying out offences such as street robberies.

Ambulance officers said 18 children and one teacher suffered minor injuries, including from the broken glass. A male teacher, 43, was injured when bashed on the head from behind, as he tried to confront the attackers. A 13-year-old boy and a 14-year-old girl sustained minor facial injuries.

No kids, bad kids, suicidal kids, a billion Muslim kids. Some suggest Modernity ain't really so beautiful at all. I beg to differ but I must do a lot of explaining to make up the ground lost above. Some serious wrongs are passing around as if they're just fine. Uh uh. No matter how we look at it, our Modernity is rusting badly.
